VBMindsetter - Terms and Conditions

This agreement ("Agreement") is entered into by and between VBMindsetter ("Coach") and the purchaser or user of the signature, proprietary processes, and materials ("Client"). By purchasing and accessing the Coach's mindset coaching services for the sport of volleyball, the Client agrees to abide by the following terms and conditions:

1. Scope of Services:

a. The Coach will provide the Client with access to signature mindset coaching processes, materials, and resources specifically designed for the sport of volleyball.

b. The services may include but are not limited to personalized coaching sessions, instructional materials, and other proprietary content.

2. Proprietary Materials:

a. All materials provided by the Coach are proprietary and confidential.

b. The Client acknowledges that unauthorized reproduction, distribution, or sharing of these materials is strictly prohibited.

3. License and Use:

a. The Coach grants the Client a limited, non-exclusive, non-transferable license to use the provided materials solely for personal development in the context of volleyball mindset coaching.

b. The Client shall not sublicense, transfer, or otherwise make the materials available to any third party without the Coach's prior written consent.

4. Payment:

a. The Client agrees to pay the specified fees for access to the Coach's mindset coaching services.

b. Payment is non-refundable once access to the materials has been granted, unless agreed upon by Coach in writing.

5. Confidentiality:

a. The Client agrees to keep all coaching sessions and materials confidential.

b. The Coach will also maintain the confidentiality of any personal information shared by the Client during the coaching sessions.

6. Social Media and Marketing:

a. The Client agrees that the Coach may share testimonials, success stories, or other feedback on the Coach's social media accounts, website, or other marketing materials.

b. The Client has the option to opt-out of such promotional activities by providing written notice to the Coach.

7. Termination:

a. Either party may terminate this Agreement with written notice if the other party breaches any material term or condition.

b. Upon termination, the Client shall cease using all proprietary materials, and no refunds will be provided.

8. Disclaimer:

a. The Coach does not guarantee specific results, and the effectiveness of the mindset coaching may vary from individual to individual.

b. The Client acknowledges that mindset coaching is a subjective process, and outcomes are influenced by various factors.

9. Governing Law:

a. This Agreement shall be governed by and construed in accordance with the laws of the state of Utah, United States of America.

b. Any disputes arising out of or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the state of Utah, United States of America.

10. Amendment:

a. This Agreement may be amended only in writing and signed by both parties.

By purchasing and accessing the Coach's mindset coaching services, the Client acknowledges that they have read, understood, and agreed to these terms and conditions.
